The charges against Mayor Evelio R. Leonardia et al docketed as Civil Case No. 07-12940 which were filed by Miguel M. Carriedo and his co-plaintiffs challenged the legality of the "Contract for the construction and site development of the Bacolod City Government Center," dated December 27, 2006 as entered between the City of Bacolod and Hilmarcs Construction Corporation.

Included in the complaint were among others, Councilors Greg Gasataya, Ann Marie Palermo, Jocelle Batapa-Sigue, Homer Bais, Jude Thaddeus Sayson, Napoleon Cordova, Al Victor Espino, Arturo Parreño, Goldwyn Nifras, Lorendo Dilag, Rogelio Balo, Luzviminda Treyes and several others.
The plaintiff, Miguel M. Carriedo, stated that his main interest in the case was to correct the manner that the bidding was conducted and that the accused should personally refund the City of Bacolod over P400 million, because of the anomalous manner that the bidding was conducted and awarded.
He further claimed that this civil case is not politically motivated and that he and his co-plaintiffs only want justice for the people of Bacolod.
The following press statement on the controversial cases has been issued by the of plaintiff through his legal counsel based on the Supreme Court resolution:
"With the permission of my client, MIGUEL M. CARRIEDO, he would want to inform the people of Bacolod City that CIVIL CASE No. 07-12940 which was previously dismissed by the REGIONAL TRIAL COURT Branch 44 of Bacolod City on the ground that he and his CO-PLAINTIFFS are not REAL PARTIES-IN-INTEREST is very much alive.
